Partner
Adam Kelly practices intellectual property law including patent and trademark counselling, litigation, and prosecution. Mr. Kelly’s experience in the United States and abroad is extensive, including conducting due diligence, providing strategic counseling, procuring new technologies, negotiating licenses, and enforcing or defending against infringement actions in various jurisdictions throughout the world. He represents clients in the agricultural science, biotechnology, chemical, and pharmaceutical arts, as well as in the electronic arts involving network-based computer systems, gaming, and children’s toys.
In addition, Mr. Kelly has successfully represented clients in all phases of litigation from pre-suit due diligence through trial and appeal. He has successfully obtained and defended against various types of preliminary injunctive relief associated with design and utility patent infringement actions. For both branded and generic pharmaceutical companies, Mr. Kelly has provided counsel concerning product life cycle management and handled all phases of Paragraph IV disputes under the Hatch-Waxman Act.
Mr. Kelly has successfully represented both defendants and plaintiffs in a wide variety of patent infringement cases in both federal district and appellate courts. In particular, he has substantial appellate experience arguing and practicing before the U.S. Court of Appeals for the Federal Circuit. Mr. Kelly has also represented clients in prosecution, opposition, and reexamination proceedings before the United States Patent and Trademark Office in Washington, D.C. and the European Patent Office in the Hague, Netherlands.
