Mark J. Goldberg’s primary area of practice is employment law, in connection with which he represents clients in proceedings before administrative, arbitral, local, state, and federal forums and counsels management on all aspects of employment relations.

Mr. Goldberg has represented clients in substantive areas of employment litigation involving employment discrimination and unlawful harassment, postemployment restrictive covenants, the duty of loyalty, unfair competition, breach of contract, defamation, bonus compensation, whistleblowing, intentional infliction of emotional distress, fraud, the Family and Medical Leave Act (FMLA), and general commercial matters.

Mr. Goldberg has also counseled clients on a variety of employment-related issues, including hiring procedures, employment agreements, terminations, discrimination, harassment, employment policies, obtaining and using background reports, compliance with the FMLA and Fair Housing Act, electronic platform policies, workplace privacy, and wage and hour issues.

Mr. Goldberg drafts forms and releases; employee handbooks; social media policies; ADR programs; and employment, termination, confidentiality, noncompetition, and consulting agreements for companies.

Mr. Goldberg also conducts workplace investigations and provides management and employee training sessions workplace sensitivity, performance management, and employment policies.

Mr. Goldberg has had general commercial litigation experience in the areas of general commercial transactions, secured transactions, environmental law, securities law, products liability, and mortgage foreclosures.
